Rules for Responsible Reformatting: A Developer Manifesto

If you develop mobile sites you might want to take a look at the following information posted by Luca,

I think is important that all mobile developers understand the implication of such issues. There are some discussions going on and hopefully the mobile developer community will make sure these issues are resolved.
A point that I already point out sometime ago was on Copyright issue. Beside the technical aspects, I want to put the attention on Copyright. All mobile sites are copyrighted, which means, content (text, images and so on) is copyrighted, but also the layout, the look of the mobile site. Now transcoding a mobile site with copyrights without permission is pretty much republishing without permission copyrighted material?

I am not an expert on copyright and internet so maybe someone can help me out understand?
